The American Asylum for the Education and Instruction of the Deaf and Dumb known today as The American School for the Deaf was the first school opened to students with disabilities. This school was established in Hartford, Connecticut and was a major landmark for students with disabilities. This school provided the opportunity of education to students with disabilities in times when they were denied education. -
The Council for Exceptional Children was founded in Columbia University by a group of educators still attending university along with their faculty. Since its founding the council has grown and expanded its recognition. This council works to improve the educational outcomes of students with disabilities. Before this ruling children with disabilities did not have much access to free public education. This lawsuit was brought to trail due to seven children within the schooling age that were denied public education due to their disabilities. The court ruled that all school aged children with any disabilities have the right to public special education. -
The Vocational Rehabilitation Act Section 504 prohibits the discrimination of individuals with disabilities. It makes it unlawful for places with public funding to deny individuals with disabilities their services. This section also ensures that students with disabilities have equal access to education and have the necessary accommodations and modifications. The Education for All handicapped Children Act also known as Public Law 94-142 Mandated suitable educational services for students with disabilities within the ages 3-21. This event although monumental was amended in 1990 and changed to The Individuals with Disabilities Education Act (IDEA) as we know it today. IDEA implemented least restrictive environment (LRE), individualized education program (IEP), and many more important policies that improved the education for students with disabilities. -
The Honig v. Doe case was brought to trial over two students with disabilities that were expelled from school. The court recognized that students with disabilities cannot be punished over wrongdoing caused by their disabilities. This case enacted the zero reject policy meaning that these students are still eligible FAPE even after suspension or expulsion and it is unlawful to remove students from school due to their disability. -
The No Child Left Behind Act provided more accountability from schools to ensure that all students achieve academic proficiency including disadvantage students. The act also used research based evidence to ensure that the educational programs can allow students to succeed. Parents were also given the choice to move their children out of tittle 1 schools through this act. -
L.H. v. Hamilton County Department of Education was brought to trial after a public school denied a ten-year-old boy with Down Syndrome placement in a general education classroom. The parents had to place the child in a private school in order for him to be in a general education classroom. After suing the public school for the expense of the private school the court ruled in favor of the parents. The courts decision agreed that the school violated IDEA as they did not provide a LRE.
