It is found that for children, "to separate them from others of similar age and qualifications solely because of their race generates a feeling of inferiority as to their status in the community that may affect their hearts and minds in a way unlikely ever to be undone." Families of disabled children begin using this court decision as a basis for suing school districts for discriminating against their children.

The No Child Left Behind Act is an amended version of the Elementary and Secondary Education Act (ESEA), started in 1965. NCLB pushed for more accountability. It required higher qualifications for teachers, allowed for more school choice, and legislated for early reading programs. It penalized schools that did not show improvement.
