    This Supreme Court ruling declared segregation in schools unconstitutional as it overturned Plessy vs. Ferguson ruling on "separate but equal." Brown vs the Board of Education led to an intentional understand that all people regardless of their gender, race or disability deserve the right to public education.

    Elementary and Secondary Education Act (ESEA)

    Federal general aid and resources were provided to ensure that a quality education was accessible to disadvantaged children. This allowed families to access and receive public education including children with disabilities also helping develop educational programs which supported children with disabilities.

    The Section 504 was the first viability civil rights law. Discrimination against children with disabilities is prohibited amongst programs that receiving federal assistance.

    The Education for All Handicapped Children Act

    The act protects all children with mental or physical disabilities providing them with an equal access to public education. Thus, making it requirement for any public school receiving government funding. Children who are in need of Special Education services are guaranteed to receive appropriate services.

    Promotes an inclusive environment as it intends for children with disabilities to have the ability to form part of the programs and services general education students have access to.
  • Individuals with Disabilities Education Act

    Individuals with Disabilities Education Act

    Students with disabilities between the ages of 3 and 21 years old have the right to a Free and Appropriate Public Education. Thus, requiring schools to provide special education services to students who have or are suspected to have a disability based on documentation for further testing. This made an impact because students are now able to be protected through an Individualized Education Program.

    In the reauthorization general education teacher now form part of the IEP team for students who receive general education minutes.
  • No Child Left Behind Act

    No Child Left Behind Act

    This act requires state testing for all students grades 3rd-8th with the intention to close achievement gaps and student proficiency in Reading and Math while bringing test-based accountability in public schools.
  • IDEA

    IDEA

    This law requires school districts to now extend their realm of public education and reach out to students who are in a private school or homeschool setting. The development of an Individualized Education Program is required and early interventions are provided.This provides special education students to receive inclusive and individualized instruction.
