The first state constitution in California extends property rights to women. "All property, both real and personal, of the wife, owned or claimed by her before marriage, and that acquired afterward by gift, devise, or descent, shall be her separate property; and laws shall be passed more clearly defining the rights of the wife in relation as well to her separate property, as to that held in common with her husband."

The American Equal Rights Association is ruined by disagreements on whether or not to support the proposed Fifteenth Amendment which would give voting rights to African American males while avoiding the women's suffrage entirely. Elizabeth Cady Stanton and Susan B. Anthony founded the National Woman Suffrage Association (NWSA), to achieve the vote through a Constitutional amendment as well as work for other woman’s rights issues.

Susan B. Anthony votes for Ulysses S. Grant in the election, is arrested and brought to trial in New York. 15 other women are arrested for illegally voting. Abigail Scott Duniway convinces Oregon lawmakers grant a law stating a married woman’s rights including starting and running her own business, having control over the money she earns, and the right to protect her property if her husband leaves.
