  • 30 Days - Child Find/Referral - ED 1105

    The LEA must comply with 34 CFR 300.111(c). The LEA is responsible for finding, evaluating and identifying all children suspected of disabilities from ages 2.5-21, (NH Rules, 2012). This must happen within the first 30 days of school. Yell (2012) explained the process must be conducted annually. Referrals from parents or others are handled by the IEP team. If the referral does not come from the parent, the LEA must notify the parent of the referral (NH Rules, 2012).

  • 15 Days - Disposition of Referral - ED 1106

    NH Rules (2012) stated that within 15 days of a referral the IEP team must give parents written notice of the nature of it in accordance with Ed 1120.03(b). Also within 15 days, they must identify if concerns can be addressed within a general education setting or if further evaluation is needed (NH Rules, 2012). According to NH Rules (2012), the referral process provides FAPE.
  • Evaluation 60 Days, Determination 45 Days - ED 1107

    The LEA must comply with 34 CFR 300.301 - 34 CFR 300.311. According to NH Rules (2012), an initial evaluation must be conducted within 60 days of the referral and the determination be completed within 45 days (p. 43, 48). This must happen before any special education services are provided (NH Rules, 2012). RtI may be used as a method of evaluation.
  • 45 Days - Eligibility Determination - ED 1108

    The LEA must comply with 34 CFR 300.301-311. A determination must be made based on “aptitude and achievement tests, parent input, and teacher recommendations, as well as information about the child’s physical condition, social or cultural background, and adaptive behavior” (NH Rules, 2012). A student must fall into a category outlined in Ed 1102.01(f). At this point an IEP must be developed.
  • 30 Days - IEP - ED 1109

    NH Rules (2012) stated, an IEP meeting must be held within 30 days of eligibility determination (p. 63). An IEP must meet NH Rules Ed 1109.01 and 1109.03. NH Rules (2012) explained that an IEP must not exceed a year in length. If a written request for an IEP meeting is made this must be conducted within 21 days of the receipt (NH Rules, 2012).
  • 30 Days - Placement - ED 111

    Students with disabilities must be educated in the LRE with non-disabled peers. The length of the school year and day must be the same as a child with no disability (NH Rules, 2012). FAPE must be followed. If placement for a LRE is determined to be outside of a public school, the district must pay for it.
  • 21 Days - Progress Monitoring - ED 1109.06

    If a parent sends in a written request for an IEP meeting, one must be held within 21 days of receipt in accordance with Ed 1109.06. Monitoring is essential component of an IEP because it will show improvement. The IEP will outline the goals a child must meet as well as the plan to obtain those goals (NH Rules, 2012).
  • Triennial Evaluation

    Must comply with 34 CFR §300.303. A reevaluation must occur once every three years unless requested. Reevaluations may not exceed one per year. NH Rules (2012) explains, evaluations must be done before a change in eligibility can be made. This determines if students still meet the eligibility requirements to receive special education services.
