  • Disability Suspected and School District Child Find Requirements

    Anyone can refer a student if a disability is suspected. Also, all school districts using the special education process, shall find, identify, and evaluate all children suspected to be children with disabilities who are 2.5 years of age or older but less than 21 years of age to ensure that eligible children are
    found, identified, and provided needed services
  • Referral

    Once the student is suspected of having a disability, he is then given a referral. There is not time limit between when a student is suspected of having a disabiity and when the referral must happen. In this case I have alloted one week, or seven calendar days.

    15 Days Between Referral and Disposition of Referral Meeting

    10 Day Notice

    Parents must receive at least a 10 day notice before an IEP meeting
  • IEP Meeting (within 15 days of the Referral)- This is the Disposition of Referral Meeting

    At this meeting the IEP team looks at the evidence and decides if there is a disability, or they order testing.

    45 Days School Must Complete Evaluations and have Report Ready

  • Evaluation

  • Determination of Eligibility and Disability Category

    Determination of Eligibility and Disability Category
    The Determination of Eligibility Category comes sometime after the Evaluation Reports - there is no specific time period defined.

    This is when the Student is classified as having one of the 14 disabilities listed in the IDEA
  • Period: to

    30 days To Write the IEP

    School has 30 Days to Meet and Write the IEP
  • Determination of Educational Placement

  • Development and Approval of the IEP

  • Period: to

    14 Days

    Parents have 14 days to approve and sign the IEP
  • Implementation and Ongoing Monitoring

    The IEP is updated every school year
