In 1840, Rhode Island would pass a law regarding education for children. This law dictated mandatory education for ALL children. This would have children receive education and the government has to provide it.

President Abraham Lincoln authorized the Columbia Institution for the Instruction of the Deaf and Dumb and Blind in 1857. In 1864, Congress allowed this institution to give college degrees which Lincoln signed into law. Today, the institution is known as Gallaudet University.

The Council for Exceptional Children was created by educators attending the summer session at Columbia University in 1922. The Supreme Court ruled that separate but equal was unconstitutional. This ended the segregation in schools throughout the United States. This ruling would later be the foundation for a future act concerning children with disabilities. Video

The Board of Education of District of Columbia was a case in which 7 students with disabilities were denied education from their school. Parents decided to file a law suit against the Board of Education for denying education. As a result, the ruling was that free public education or a suitable alternative must be provided to all students regardless or need or cost.

The Education for All Handicapped Children Act required public schools to provide equal education and one free meal a day for children with disabilities through federal funds. This act would be changed to the Individuals with Disabilities Education Act requiring schools to give specialized educational services to children with disabilities. Children with disabilities were undergoing the mainstream model at this point, where they would be placed with normal students depending on their disability.
