  • Diana v. State Board of Education

    Diana was a student in Soledad Unified School District in California who was having academic challenges in class, and after being assessed by the school's psychologist, using the Standford Binet Intelligence Test, it was determined that she had mild retardation and she was then placed in EMR class. Due to the bias of the IQ test, a class action lawsuit was filed on behalf of 9 Mexican American children.The Plantiffs arguement was the test was bias because the chlidren couldn't comprehend it.
  • Larry P. v. Riles

    Larry was a student in San Francisco Unified School Dristrict who was having acadmic challenges in class, and because of those challenges he was assessed by the school's psychologist; it was determined, after using the Stanford Binet Intelligence Test, that he had mild retardation so he was taken out of general ed class and placed in "Educably Mentally Retarded" (EMR) class. There was a class action lawsuit for five African American students who were placed in the EMR class due to test results.
  • Board of Education v. Rachel Holland

    Rachel was a child with a low IQ score and below average developmental level, and attended several special education programs, but her parents wanted her to be in general ed class full time instead of 1 hour or half school day. The Hollands argued that their child would benefit greatly from general ed class with appropriate support, and the plantiffs argued that it would take up too much time to accommodate her in genral ed class and that it would also be costly to do so.
