    Department of Public Welfare v. Haas
    Supreme Court of Illinois ruled in favor of excluding students with disabilities from public school education.
  • Elementary and Secondary Education Act (ESEA)

    Elementary and Secondary Education Act (ESEA)
    Equal access to the public education system for students from disadvantaged backgrounds. ESEA included a grant program for states to develop and improve programs for students with disabilities.
  • Education of the Handicapped Act

    Education of the Handicapped Act
    Revision of the ESEA that supported state run programs for individuals with disabilities. The initial goal of special education was provide students with disabilities with an opportunity to attend school and benefit from education.
  • Vocational Rehabilitation Act (VRA)

    Vocational Rehabilitation Act (VRA)
    Federal law that approves grants to states for vocational rehabilitation services. VRA defined handicapped person and appropriate education and prohibits discrimination in in federally funded programs.

    State funding for students with disabilities and students who are gifted and talented as well as due process rights for students/families.
  • Education for All Handicapped Children Act (EAHCA)

    Education for All Handicapped Children Act (EAHCA)
    Also known Public Law 94-142. Schools are required to ensure that all children, regardless of their ability receive free and appropriate public education. Education is provided based on the identified needs of students with learning disabilities ages 3-21 years old.

    Americans with Disabilities Act (ADA)
    ADA is a civil rights law that prohibits discrimination against individuals with disabilities in all areas of public life. The goal of ADA is to make sure that people with disabilities have the same rights and opportunities as everyone else. It prohibits discrimination in the private sector and protects equal employment opportunities for people with disabilities.

    Requires that students with disabilities receive services even when expelled, grants use of developmental delay category through age 9, requires access to general education curriculum and state/district-wide testing, IEP team includes a general education teacher and a behavior plan, offers mediation options, and limits attorneys fees.

    An ammentment to the IDEA.Allows the Response to Intervention (RTI) to determine the presence of a learning disability, does not require the use of the severe discrepancy model, increases funding for early intervention services for children who do not require special education, eliminates IEP short-term objectives for some students, increases special education licensure standards, involves policies to prevent over-representation of minority students in special education.
