  • Referral is made

  • Disposition to Referral Meeting

    Disposition to Referral Meeting
    The IEP team has 15 business days to decide if existing resources can meet need, if additional information is needed, and what additional evaluations (if any) are needed. Also, written consent for further evaluation and parental notification of the referral is necessary during this same time.
  • Evaluation

    Evaluation
    Within 60 days of parents providing consent a full and thorough initial evaluation must take place. At the end of this period a written report must be made available to the parents as well as a notification of their rights.   • Extension

    Extension
    No extension for the initial evaluation is allowed unlike federal law. However, a 30 day extension is allowed if parents and the school agree in the case of a reevaluation. Individuals with Disabilities Education Improvement Act (IDEIA), 20 U.S.C. § 1400 (2004).
  • Wait to IEP Meeting

    Wait to IEP Meeting
    There is at least a 5 day wait time from when parents receive the evaluation report so they can review it. Note this can be waived in the parent agrees to it. Also note this differs from the 10 day wait time in federal law.
  • IEP Development

    IEP Development
    Once evaluation report issued (if qualifying disability exists) the IEP team has 30 calendar days to write the IEP.
