    Katherine was born with significant health issues that required attention physically at least 3 times daily. She and her parents sought "free and appropriate public education. DOE offered her a homebound program, this program did not offer her the " least restrictive environment, under the "Education for all Handicapped children Act of 1975"(EAHCA).     Stuart By and Through Stuart v. Nappi
    Kathy Stuart, obtained a preliminary injunction to prevent the board of education from expelling her from high school, and a order for the board of education to conduct a review of her special education program. Over the next 5 years she sought a permanent injunction and a declaratory judgement that states " if the EHA desired to exclude a handicapped student from class that it is no longer than a ten day period. www.leagle.com
  • Jefferson County School District R-1 v. ELIZABETH e., BY AND THROUGH HER PARENT'S ROXANNE B. AND DAVID E.,

    Elizabeth had significant mental-health issues and a history of aggressive behavior at school and at home. She was moved to a private high school as a freshman. After a settlement was reached under the IDEA Act the district agreed to pay half of the tuition for the private school. After 2 years her parents moved her and twice and wanted the district to pay the cost although she was not a student in that county. They won the case. www.leagle
