  • Mills v. Board of Education of District of Columbia

    In 1972 a lawsuit was taken out to protect seven children’s rights to education They were denied placement in a public educational program for substantial periods of time because of alleged mental, behavioral, physical or emotional disabilities
    The court agreed that no child can be denied education due to the disabilities they had based on the school’s defense. The schools defense was lack of funds/resources to address the student’s needs.

  • Hendrick Hudson Central School District v. Rowley

    In 1979 Amber Tratos needed assistance due to a medical condition with a process called clean intermittent catheterization. The schools position was that it was outside their IEP and scope of related services.
    Outcome: The court ruled this was not a medical service but a related service. Therefore, the judge told the school to update the IEP to list it as such so it is a required daily occurrence in her day.

  • Irving Independent School District v. Tatro

    In 1982 Amy Rowley’s a deaf student who was refused a sign language interrupter. The schools defense is she was doing well and was progressing the same as the other children in her class. Her parents feel she was not excelling to her maximum potential. Outcome: Amy was smarter than others it does not mean she is at her maximum potential. Therefore, she was not able to hear equally which could hold her back and not allow her to learn as much as possible
