Mills versus the District of Columbia Board of Education was a landmark legal case wherein it was ruled that schools must provide the services necessary for disabled children to attend school at no additional cost to their parents or guardians. -
The Rehabilitation Act of 1973 was one of the first major legislative advances in disability rights. Of particular importance is Section 504 which states, "No otherwise qualified handicapped individual in the united states...shall, solely by reason of his handicap, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance." -
The education for all Handicapped Children Act mandated schools to provide a free appropriate public education (FAPE) to students with disabilities in the least restrictive environment. -
Honing versus Doe was a landmark legal case in which it was ruled that students with disabilities cannnot be expelled for behaviors relating to their disabilities. -
The hard fought for Americans with Disabilities act made it illegal to discriminate against anyone with a disability in any setting. -
The Individuals with Disabilities Education Act or IDEA, was the Handicapped Children Act renamed and expanded upon. Services provided are expanded, and students are granted additional rights. -
The 1997 version of the Individuals with Disabilities Education Act added mediation as an option, made sure that students still recieve services in the event of their being expelled, state that students with disabilities should take state tests, added behavior management plans, and added general education teachers to IEP teams. -
The 2004 Individuals with Disabilities education act is the previous version expanded and improved apon. Namely, funding is improved, and special education teachers are required to meet higher standards for licensing and certification. -
However, increased understanding and diagnosis is still needed. Equity in special education still needs to be improved. Further funding would serve to help with both of these goals. We must continue to strive to make sure all students recieve the free appropriate public education they are entitled to. -
Special education has come a long way in the last 100 years. Between IEPs and 504 plans students with disabilities have more recognition and opportunites for a quality public education than ever. In addition, increased rights for both students and their parents and guardians, makes it easier for students and their parents and guardians to advocate for their needs. -
