  • Brown vs. Board of Education

    The Supreme Court had ruled that it is unconstitutional to separate children in public schools according to the child's race. This will put a stop to racial segregation in our schools. The principle of "separate but equal" was set forth in the 1896 Plessy vs. Ferguson case. This ruling was a violation of the 14th amendment.

    Honig vs. Doe 484 U.S. 305 (1988)

    The Supreme Court had addressed the IDEA to "stay put" provision the education which is the Handcapped Act that had prohibited the state or the schools from shutting out students with disabilities. This stopped them from being in the classroom if they have disruptive behavior that is from them having disabilities. The court also recognized that IEP the heart of IDEA education distribution system and told that Congress showed emphasized during the Act. .
  • Schaffer vs Weast, 546 U.S 49 (2005)

    This was a case of the parents of Brian Schaffer, a handicap child, sued the public school district under the Individuals with the Disabilities Education Act(IDEA). His parents stated that the devise that is required for disabilities was inadequate. The district court ruled for the Schaffers side but the Fourth Circuit reversed. However, challenging the lower court was incorrectly allocate the burden of proof for the school system. The purpose was the IDEA was silent
