TN NAFTA/USMCA Applications: CBP continues to process TN applications at the POEs. Applicants should keep in mind that they must have work scheduled in the U.S. before submitting their application. No flag polling is allowed. In other words, an applicant cannot simply show up at a POE to process their TN application and then turn back home to Canada. Issues could cause more risk between Biden and AMLO are labor, environmental and energy. Democratic lawmakers were more insistent on including labor clauses in the T-MEC and promoted the idea of inspectors to ensure that Mexico complies with the rules. Sen. Monreal pledged to work with private energy companies ensure proposal doesn’t clash with USMCA. “We are going to listen to them.. the bill can be modified, enriched and improved,” Monreal said noting investors threatening legal action if law is passed in current form. “I have a lot of hope that it will be reviewed closely and won’t violate USMCA or constitution.
