Timeline: Important Special Education Cases

  • • Larry P. v. Riles

    Black and other minority children were wrongly placed in Special Education classes due to assessments. In the late 1970s, there was discrimination towards minorities and the assessments were a filter to place the minority children behind.-Ruling:The assessment would produce a disadvantage.The education was not equal to the general education students. -Importance: Race and disabilities shouldn’t be an obstacle for students. Children are to attend school with an equal chance to succeed.
  • Board of Education of the Henrick Hudson School System v. Rowley

    Rowley, a deaf student, placed in general education class. Rowley wasn't considered with Special needs.- Ruling: FAPE ensures Special Education students to reach their full potential. The school needed to provide the interpreter service. -Importance: The Education for All Handicapped Children Act of 1975 grants federal funds to the schools to provide the necessary services for Special Education students. Schools have no financial hindrance since federal funds are available.
  • Cedar Rapids Community School District v. Garret F.

    Garrett required nurse care while attending school. Garrett's mom asked for the school District to provide the service; it was denied. -Ruling: There was documentation that other Special need students would benefit the services of the nurse during school hours. Under FAPE, Garrett was able to have the District to provide the service by hiring a nurse. -Importance: It was a milestone for the Special Education students to have the appropriate services available while attending school
