The US Surpreme Court ruled that the rights of students differential treatment based on language minority staus but this doesn't go into a particular intructional approach. But it remedies the requirments identifing placement into a bilingual programs.

    The Federal District Court for the Eastern District of New York found that Pastchogue- Medford Scholl District's tranitional bilingual program was essentially a course in English. The students were denied an equal educational opportunity by not getting accademic intruction in Spanish. And the court stated, denial of educational opportunties to a child in the first years of schooling is not justified by demonstrating that the educational program will teach the children English sooner.

    Texas district court in 1981 found that it failed to help ELLS children overcome lauguage barriers according to the equal education opportunities act . At the time the case was in appeal. Texas passed a law expanding bilingual education for grades k-6 and giving english as a second language was for 7-12 grades. The fith circuit held the issue was a moot point because the stat's revised language program must be given a chance to work
