    The defendant was made to drive the a car to the location where a victim was killed and drove the criminals from the crime scene under threat. The court allowed the defence of duress. The case of Howe overruled the case of Lynch and therefore changed the law.

  • Case of Howe

    The case of Howe was an example of binding law. Howe was forced to murder someone under duress but the court that follows jugde made law, said that he could not use this as a defence. He was 19 when he was under duress to act out the two murders of Elgar and Pollitt.
  • Case of Gotts

    A 16 year old boy, who was ordered by his father to kill his mother, was charged with attempted murder and the trial judge ruled that the defence of duress was not available to him.
