  • Commonwealth of Pennsylvania vs. Pennsylvania Association for Retarded Children

    PARC: Do not teachable education on the mental stage of a 5-year-old but is physically like a 21-year-old, this gives the kids more chances of different resources and growth.
    Commonwealth: The schools are to not include the students that can not reach the mental capacity but at the same time they are being enrolled in the first grade.
    Court: They agreed with PARC to not deny and child to attend a public school program.

    Broad of Education District Columbia Vs. Mills

    Mills was fighting for 7 different students because these students got denied of being placed because of the allegations of due process. The broad claimed that they could not afford to have these students taught because of their financial situations. Instead of broad-reaching out and asking for extra help, they refused the students with a court order paper. The court's final decision was that the broad of education must give the proper education to all students regardless of their disabilities.

    These parents had a child that was disabled from cerebral palsy and their child was denied access to be a part of the special education classroom.
    School: Did not want to allow the child to come to school and give him an education opportunity like the other kids.
    Court: Their decision was that the school had to teach the child and could not judge him because of his disability.
