    Mills v. Board of Education of District of Columbia, 348 F. Supp. 866 (D.D.C. 1972)
    This landmark court case involved seven children who were excluded from schools in Washington DC because of behavior and hearing difficulties. The school district contended that it did not have enough money to finance their special education. But the court ruled on their favor as the schools were ordered to readmit them and serve them appropriately. This is because financial constraints would not be allowed to infringe the rights of children with disabilities.
  • Honig v. Doe, 484 U.S. 305 (1988)

    This landmark court case was ruled that disabled children cannot be excluded from school for any misbehavior that is as a result of disability. For instance, the emotionally handicapped students might carelessly respond to emotional attacks from their fellow students. But if their misbehavior is not in any way related to their disability then the educational services can be stopped.The court case rulings have critically supported an effective provision of fundamental rights to disabled students.

    Schaffer v. Weast, 546 U.S. 49 (2005)
    This landmark court case involved Brian Schaffer, a disabled child, his parents, and the school. The parents sued the school under the Individuals with Disabilities Education Act. Schaffer's parents claimed that the IEP devised on their son was quite inadequate. The district court ruled in favor of the Schaffers but, the fourth circuit reversed the ruling stating that the lower court incorrectly assigned the burden of proof to the school. https://www.wrightslaw.com/news/05/schaffer.weast.htm
