    This was class action lawsuit , this lawsuit was on the behalf of seven children who were denied the opportunity to attend public educational because of alleged mental, behavioral, physical or emotional disabilities. This lawsuit was on the grounds that the students were being denied their constitutional right to Due Process.     The school, down syndrome student would not benefit in a general education classroom. Case result: School determines if in a regular classroom, with appended devices/services, would suffice. If student is to be removed from the general education classroom, the school must determine if the child has been allowed time spent the regular classroom to the maximum extent possible.     Class action lawsuit, suing for money damages by a handicapped child and his parents against a public school teacher and other school officials for refusing to accommodate the child’s handicapping condition in the classroom. General education high school history teacher failed to comply with an IEP.
