Mr. Avery and his team made the motion on December 17th 2018 to have evidence tested via rapid DNA identification. Kathleen Zellner, his attorney, responds with this clarification: “The bottom line is that the appellate court is not preventing Avery from doing the bone testing after the appeal is completed or by agreement with the new attorney general while the appeal is pending.”

The appellate court has jurisdiction of the entire appeal which has numerous issues. The appellate and supreme court of Wisconsin will make the decisions that matter on these issues and establish precedent on these issues"
