On May 9, 1861, he became 5th New York Infantry. This was after he had served a short term of being a commissioned second lieutenant.

On June 10, 1861, he was the first officer of the union army to get wounded in the war. This happened at the Battle of Big Bethel.

He was put in jail in 1862 under suspicion that he had sold confiscated Confederate livestock and provision for personal gain.
