When governor elect Eugene Talmadge died, the General Assembly appointed his son, Herman Talmadge as governor. The lieutenant governor Melvin Thompson thought that he should be the new governor. Outgoing governor Ellis Arnall also refused to leave the office.The Georgia Supreme Court decided for Melvin Thompson.
