After Shay’s Rebellion was suppressed, the Government realized the flaws of the Articles of Confederation, and sought ways to avoid such revolutions. However, only five states were represented in the conference due to the weakness of the central government under the Articles of Confederation. Therefore, Alexander Hamilton addressed delegates from all 13 states to assemble in Philadelphia on May, 1787.

After the revolutionary war, the colonies attained land to the west, and the colonies began to claim geographical rights of these lands. In order to settle this dispute, the Northwest Ordinance of 1787 was passed by the congress. The Ordinance of 1787 allowed:
- All states to agree to give up their claims to the new lands.
- The creation of a system that would create new states.
