The 12/18 motion was denied by the Appellate Court, objecting on the grounds that further scientific testing would constitute a new proceeding and such proceeding is not necessary to determine whether the circuit court erroneously denied Avery's motion.

Wisconsin AG files a response to the Avery motion for new trial based on alleged violations of Arizona v. Youngblood. Avery's attorney, Kathleen Zellner, says violations occurred when bone fragments found in a Manitowoc County quarry were handed over to the Halbach family without informing Avery. The state of Wisconsin requests that a judge not grant Avery a new trial in the Teresa Halbach murder case.

Zellner replies to the State's March 29th request that a judge not grant Avery a new trial, claiming that the State's filing "unauthorized and unsolicited". Zellner also claims that the State is asking the Circuit Court to disobey the order of the Court of Appeals.

Judge Sutkiewicz, Wisconsin Circuit Court judge, rejects Avery's bid for a new Trial based on investigators handling of bone evidence in the Halbach murder. Zellner response to this in a tweet, stating that "We are thrilled to be returning to the Appellate Court after all this time".
