  • Suing the Employer

    A group of probation officers had sued the State of Maine and their boss for allegedly violating the Fair Labor Standards Act. of 1938. The act created the right to minimum wage. It also gave the right to a "time-and-a-half" overtime pay when a worker works over forty hours a week. The probation officers said that the state and their employer were not following this acts rule. This case was dismissed in Federal court.

    The officers by now had sued the state of Maine for violating the same act. They went to state court. The state court and the state supreme court both had a ruling.
  • The Ruling

    On this date the state court and state supreme court had both ruled that the probation officers could not sue being a private party in their own states court. It was a close 5-4 court ruling.
