Elizabeth was help captive for 9 months. Mitchell believed himself to be the Prophet Immanuel. He was a polygamist that performed a wedding ceremony where he married Elizabeth. He was a performed polygamy as his wife helped with Elizabeth, Elizabeth was raped daily. She was cabled to a tree, forced to drink alcohol and smoke tobacco, and he often didn't feel her.

Elizabeth was kidnapped in the early morning from the room she shared with her sister. She was awoken by the sound of footsteps, and something cold against her cheek (a knife). She was told to remain silent and to get up or else she and her family would be killed. The man who kidnapped her was named Brian Mitchell. Mitchell led Elizabeth out of their house, and through the woods for hours.

Richard Ricci was charged with burglarizing the Smart's home. He became the top suspect for Elizabeth's kidnap.

Smart's sister Mary Katherine was fake sleeping when the man abducted Elizabeth. She recognized the man, but couldn't pinpoint who it was at first. In October she realized that it was Immanuel who had kidnapped Elizabeth. Immanuel was a man that the Smart's mother had hired in November 2001 to fix some things around the house.

Elizabeth was seen walking with Mitchell and Barzee in Sandy, Utah. (5 miles from her home) Mithcell and Barzee were arrested.

Both Mitchell and Barzee are charged with six felony counts, including aggravated burglary, aggravated kidnapping, aggravated sexual assault and two charges for allegedly trying to break into the home of Smart's cousin, Jessica Wright.

Wanda Barzee, Mitchell's wife, claimed that Mitchell manipulated her into kidnapping Smart by using family, religion, and music.
